BISMARCK, N.D. — Law enforcement officials closed roads and evacuated residents in southeast Bismarck on Thursday afternoon after a man being arrested on warrants allegedly made threatening statements toward officers.
Brian Schilling, 60, was arrested on a bench warrant for a 2006 case in which he failed to show up for a hearing and a warrant of attachment. Burleigh County Sheriff's Major Kelly Leben said Schillling could face additional charges pending the investigation into his arrest.
Leben said deputies went to a home in the mobile home court at 1119 University Drive to serve the warrants at approximately 2 p.m. Deputies made contact with Schilling, and he allegedly made threatening statements about firearms. When Schilling reached for an object that the deputies felt could be a firearm, they left the residence, set up outside and requested assistance.
Officers from the Bismarck Police Department and North Dakota Highway Patrol and additional officers from the Burleigh County Sheriff's Department arrived to assist in evacuating people from homes that officers felt were in a dangerous area, Leben said. After the evacuations were completed, law enforcement set up a perimeter around the neighborhood and called in the West Dakota SWATteam. When the SWAT team arrived, Schilling surrendered without incident, Leben said.
Officers were in the process of doing follow-up investigation and obtaining search warrants for the home later Thursday afternoon, Leben said.
According to court documents, a warrant was issued for Schilling's arrest on May 16, 2006, after he did not show up for a pretrial conference in a case in which he was charged with possession of methadone, possession of marijuana and two counts of possession of drug paraphernalia. No further information was available on the other warrant on which Schilling was arrested. Leben said warrants of attachment typically are issued to order a person to appear in front of a judge and often are issued in child-support cases.
